Occupational Safety and Health Administration extends Hazard Communication Standard compliance dates by four months
As of our last check on November 2, 2026, this is in effect, since January 15, 2026. Compliance date: May 19, 2026.
We check the Federal Register daily for later actions. We check federal court opinions for rulings on published rules weekly, on Mondays. A ruling can take time to reach us, so not finding one here does not mean there is none.
In short
- What changed
- The Occupational Safety and Health Administration (OSHA) moved each of the four compliance dates in its updated Hazard Communication Standard four months later. The first deadline moves from January 19, 2026, to May 19, 2026, and the last moves from January 19, 2028, to May 19, 2028.
- Who's affected
- Chemical manufacturers, importers and distributors that evaluate substances or mixtures, and employers that need to update workplace labels, their hazard communication program or employee training for newly identified hazards.
- What to do
- This rule creates no new duties: it gives more time to meet existing ones under the updated standard. Move your deadlines to May 19, 2026, November 20, 2026, November 19, 2027, and May 19, 2028. Until then, you may follow the 2012 standard, the updated standard, or both.

From the sourceSupplementary Information, I. Overview
OSHA has determined it is necessary to extend the initial compliance date in paragraph (j)(2)(i) by four months to allow time for the agency to publish the necessary guidance materials
Also: Supplementary Information, I. Overview
To maintain the tiered approach to compliance adopted in the final rule (89 FR 44144, 44302), OSHA is also extending each of the subsequent compliance dates in paragraph (j)(2)(ii) and (j)(3) by four months.
OSHA says it moved the first deadline because its guidance on the updated standard was not ready, and it wants time to publish that guidance and for the regulated community to review it. It moved the later dates to keep the tiered schedule.

What it means in practice
-
Our analysisSupplementary Information, II. Exemption From Notice-and-Comment and Delay of Effective Date
this extension merely maintains the status quo for a short period of time.

Our analysisSupplementary Information, I. Overview
OSHA has determined it is necessary to extend the initial compliance date in paragraph (j)(2)(i) by four months to allow time for the agency to publish the necessary guidance materials
OSHA plans to publish guidance on the updated standard before the new first deadline, which may help organizations finish their compliance work.
-
Our analysisSupplementary Information, I. Overview
To maintain the tiered approach to compliance adopted in the final rule (89 FR 44144, 44302), OSHA is also extending each of the subsequent compliance dates in paragraph (j)(2)(ii) and (j)(3) by four months.
Because the tiered schedule is kept, employers still have the same gap after the supplier deadlines to update their own labels, programs and training.
